Terms and conditions

§ 1 Initial Provisions

  1. The online store JM Sante Pharma, available at jmsante.pl, is operated by JM SANTE PHARMA Sp. z o.o. based in Sosnowiec, registered in the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under number KRS 0000912373, with a share capital of 150,000 PLN, NIP 1251614007, REGON 145920490.
  2. This Regulation is addressed to both Consumers and Entrepreneurs using the Store and defines the rules for using the online store as well as the rules and procedures for concluding Sales Agreements with the Customer remotely via the Store.

§ 2 Definitions

  1. Consumer – a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to their business or professional activity.
  2. Seller – JM SANTE PHARMA Sp. z o.o., located at ul. Krzysztofa Kamila Baczyńskiego 25A, 41-203 Sosnowiec, registered in the National Court Register under number KRS 0000912373, with a share capital of 150,000 PLN, NIP 1251614007, REGON 145920490.
  3. Distance Contract – a contract concluded with the Customer under an organized system of concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using one or more means of remote communication up to and including the conclusion of the contract.
  4. Regulation – this regulation of the Store.
  5. Order – a Customer’s declaration of intent made using the Order Form and aiming directly at concluding a Sales Agreement of a Product or Products with the Seller.
  6. Account – a customer’s account in the Store, where data provided by the Customer and information about Orders placed by them in the Store are collected.
  7. Registration Form – a form available in the Store that allows creating an Account.
  8. Order Form – an interactive form available in the Store that allows placing an Order, especially by adding Products to the Basket and defining the terms of the Sales Agreement, including the delivery and payment methods.
  9. Basket – a software component of the Store in which selected Products intended for purchase are visible, and it is possible to determine and modify the details of the Order, especially the quantity of products.
  10. Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
  11. Sales Agreement – a contract of sale of a Product concluded or concluded between the Customer and the Seller via the online Store. It also refers to – depending on the Product’s characteristics – a contract for the provision of services or a work contract.

§ 4 Technical Requirements

To use the Store, including browsing the Store’s assortment and placing orders for Products, the following are required:

  1. An end device with Internet access and a web browser such as Chrome, Mozilla Firefox, Edge, Opera, Safari.
  2. An active email account.
  3. Enabled cookies support.

§ 5 General Information

  1. The Seller, to the maximum extent permitted by law, is not responsible for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the online Store with the Customer’s technical infrastructure.
  2. Browsing the Store’s assortment does not require creating an Account. Placing orders for Products in the Store is possible either after creating an Account following § 6 of the Regulation or by providing necessary personal and address data to fulfill the Order without creating an Account.
  3. Prices shown in the Store are in Polish zlotys and include VAT (gross prices).

§ 6 Creating an Account in the Store

  1. To create an Account in the Store, the Registration Form must be filled out. A login, email address, and password are required.
  2. Creating an Account in the Store is free of charge.
  3. Logging into the Account is done by providing the login and password established in the Registration Form.
  4. The Customer may delete the Account at any time without giving a reason and incurring any charges by sending a request to the Seller, especially via email or in writing to the address provided in § 3.

§ 7 Placing Orders

  1. Log in to the Store (optional).
  2. Select a Product to be ordered and click “Add to Basket” (or an equivalent button).
  3. Log in or use the option of placing an Order without registration.
  4. If the Order is placed without registration, fill out the Order Form, providing the recipient’s data, delivery address, choose the type of delivery, and optionally provide invoice details.
  5. Click the “Buy and Pay” button.
  6. Select one of the available payment methods and, depending on the payment method, pay for the Order within a specified period.

§ 8 Delivery and Payment Methods

  1. The Customer can use the following delivery methods:
    • Courier shipment,
    • Parcel locker shipment.
  2. The Customer can use the following payment methods:
    • Electronic transfers,
    • BLIK,
    • Traditional transfer,
    • Payment cards,
    • Digital wallets,
    • Deferred payments.
  3. Detailed information on delivery methods and acceptable payment methods is available on the Store’s website.

§ 9 Execution of the Sales Agreement

  1. The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order following § 7 of the Regulation.
  2. After placing the Order, the Seller immediately confirms its receipt and acceptance for execution by sending an email to the Customer’s provided address.
  3. The Product will be sent by the Seller within the time specified in its description, in the manner chosen by the Customer when placing the Order.
  4. For payment by transfer, electronic, or payment card, the delivery time is counted from the date the Seller’s bank account is credited.
  5. Product delivery is limited to the territory of Poland.

§ 10 Right of Withdrawal

  1. The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
  2. Detailed rules on withdrawal and exceptions to this right are specified in the further parts of the regulation.

§ 11 Complaint and Warranty

  1. The Sales Agreement covers new Products.
  2. In case of Product non-compliance with the agreement, the Customer has the right to file a complaint under the applicable law.
  3. Complaints can be submitted in writing, electronically, or via a form available in the Store.

§ 12 Out-of-Court Complaint and Claim Resolution Methods

  1. Detailed information on out-of-court complaint and claim resolution methods is available on the website of the Office of Competition and Consumer Protection.
  2. The Customer can submit a complaint via the EU’s ODR platform at: http://ec.europa.eu/consumers/odr/.

§ 13 Personal Data in the Online Store

  1. The Seller is the administrator of personal data.
  2. Personal data is processed to fulfill the sales agreement or – with the Customer’s consent – for marketing purposes.
  3. The Customer has the right to access and correct their data.

§ 14 Reviews in the Online Store

  1. The Customer can leave reviews about purchased products.
  2. Reviews must not contain unlawful content or violate third-party rights.

§ 15 Final Provisions

  1. Contracts concluded via the Online Store are concluded in Polish.
  2. The Seller reserves the right to amend the Regulation for valid reasons.
